Unit 1

Early Developments (1600- 1836)

Overview of the Global Legal History, Charters of the East India Company: 1600, 1661. Settlements: Surat, Madras, Bombay Courts: Mayor’s Court of 1726 and Supreme Court of 1774. Statutes: Regulating Act, 1773; The Act of Settlement 1781. Conflict: Raja Nand Kumar, Kamaluddin, Patna Case, and Cossijurah case. Adalat System: Warren Hastings’s Judicial Plans of 1772, 1774 and 1780; Lord Cornwallis’s Judicial Plans of 1787, 1790 and 1793; Lord William Bentinck’s Judicial Reforms

Unit 2

Evolution of Law and Legal Institutions

Development of Personal Laws, development of Criminal Law, development of Civil law in Presidency towns Mufassil: Special Emphasis on Justice. Equity and Good Conscience. Codification of Laws: Charter of 1833, First Law Commission, Second Law Commission. Establishment of High Courts under the Indian High Courts Act, 1861. Privy Council and Federal Court: An Appraisal

Unit 3

Constitutional Developments and Gandhian Movements

The Indian Councils’ Act, 1861, the Government of India Act, 1909, the Government of India Acts, 1919 and 1935. Accession of Princely States and Reorganization of the States. Nationalist and Civil Disobedience Movement: Gandhian Movements.

Unit 4

Framing of Indian Constitution

Government of India Act, 1935(Federal Legislative, Federal Executive and Federal Judiciary (Federal Court) under the Act of 1935). Constitutional developments leading to Indian Independence (1937—1947), the Indian Independence Act, 1947. Abolition of Privy Council. Framing of the Indian Constitution, The Constituent Assembly of India, Evolution and the source of the Indian Constitution, Salient features of the Indian Constitution

Unit 5

V: Modern and Contemporary India

Colonialism and Imperialism: Stages of Colonialism, Impact on Economy (Industry, Agriculture and Trade), Permanent Settlement and Emergence of the idea of land as a commodity. Partition: Politics and Communalism. Judicial contribution in the development of the Constitution. Contemporary challenges.

Objectives and Outcomes

Course Objectives

  1. To introduce students to the historical foundations of Indian legal and constitutional development, with particular reference to the early judicial institutions established during the East India Company period.
  2. To examine the evolution of personal, civil, and criminal laws in India, including the role of justice, equity, and good conscience, and the impact of codification and institutional reforms on the Indian legal system.
  3. To analyze the major constitutional and legislative reforms under British rule, and to understand their influence on governance structures and administrative frameworks in colonial India.
  4. To study the constitutional developments leading to Indian independence, including the Government of India Act, 1935, the Indian Independence Act, 1947, and the functioning of the Constituent Assembly in framing the Indian Constitution.
  5. To critically assess the continuing influence of colonial legal and constitutional legacies on contemporary India, particularly in relation to governance, socioeconomic structures, and judicial interpretation.

Course Outcomes

By the end of the course the learner would be able to:

  1. Demonstrate a systematic understanding of the early settlements by the East India Company, initiation of judicial developments during the time period and the working of the Courts established in Surat, Bombay, Madras and Calcutta.
  2. Examine the development of personal, civil, and criminal laws in India assess the impact of the codification movement and establishment of the High Courts.
  3. Analyse the major constitutional reforms and their influence on British Indian governance structures, laying the groundwork for India’s independence.
  4. Evaluate the role of the Government of India Act, 1935, the Indian Independence Act, 1947, and the Constituent Assembly in shaping the salient features of the Indian Constitution.
  5. Assess the continuing influence of colonial legal legacies on modern India, including socioeconomic impacts, constitutional challenges, and judicial contributions to evolving governance.

Teaching Methodology: Lecture, Group Discussion, PowerPoint Presentation etc. as per the requirement of each module.
